Plux Mobile Application — Terms and Conditions (Thailand)

These Terms and Conditions (the “Terms”) govern your access to and use of the Plux mobile application, related websites, content, products, and services (collectively, the “App”). The Terms are intended to be neutral and compatible with distribution through any mobile application marketplace and to comply with applicable laws of the Kingdom of Thailand, including the Thai Civil and Commercial Code, Computer Crime Act, Electronic Transactions Act, Personal Data Protection Act B.E. 2562 (2019) (PDPA), and the Consumer Protection Act and related regulations (collectively, “Thai Law”).

Where these Terms reference obligations “to the extent permitted by law,” that means to the extent permitted by Thai Law and other mandatory consumer protections that apply to you.

1) Acceptance of Terms

Acceptance of Terms By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy, available at [https://phithangreen.com/plux-application-privacy-policy/]. (together, the “Agreement”). If you do not agree, do not use the App and uninstall it. Your continued use after we post changes means you accept the updated Terms (see Section 16).

Electronic acceptance, records, and communications are valid and enforceable under the Electronic Transactions Act.

2) Definitions

  • “We,” “us,” “our,” or “Plux” means the App provider identified in Section 17 (Contact Information).
  • “Platform Provider” means the operator of the mobile application marketplace where you obtained the App.
  • “User Content” means content you submit, upload, post, or otherwise make available through the App.
  • “Paid Services” means any in-app purchases, subscriptions, credits, or other paid features.

3) Eligibility and User Accounts

3.1 Age and capacity. You must be at least 13 years old to use the App. If you are under the age of majority in your country (20 in Thailand), you must have the consent of a parent or legal guardian to use the App and to enter into this Agreement. By using the App, you represent and warrant that you meet these requirements.

3.2 Account registration. You must provide accurate, current, and complete information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

3.3 One account per person. We may restrict multiple accounts for the same individual where it creates risk, misuse, or non-compliance.

3.4 Device and network. You must use compatible devices and network services. Carrier and data charges may apply.

4) User Obligations and Prohibited Conduct

You agree to use the App lawfully, consistent with Thai Law (including the Computer Crime Act) and any applicable local laws where you use the App. You must not:

  • Engage in unlawful, harmful, fraudulent, deceptive, defamatory, obscene, hateful, discriminatory, infringing, or national-security–sensitive activity, or content prohibited by Thai Law.
  • Upload malware, spyware, or code that interferes with or damages the App or any network.
  • Attempt to reverse engineer, decompile, disassemble, or otherwise derive source code except as permitted by law.
  • Circumvent security or access controls, or probe our systems without authorization.
  • Use the App to send spam or harvest personal data without consent as required by the PDPA.
  • Misrepresent your identity or affiliation.
  • Infringe any intellectual property or rights of publicity or privacy.
  • Use the App in a way that harms other users or overloads our infrastructure.

We may remove or restrict content, suspend features, or report suspected violations to authorities to comply with Thai Law.

5) Intellectual Property Rights

5.1 Ownership (Plux IP). The App (including software, interfaces, graphics, designs, databases, and trademarks) is owned by us or our licensors and is protected by law. No rights are granted except as expressly stated.

5.2 License to You (End-User License). We grant you a limited, personal, non-exclusive, revocable, non-transferable license to use the App on devices you own or control, solely for personal use and as permitted by Platform Provider rules.

5.3 Restrictions. You must not copy, modify, distribute, sell, lease, or sublicense the App; remove proprietary notices; or use our trademarks without consent.

5.4 User Content; License to Plux. You retain ownership of your content but grant us a license to host, reproduce, and display it as needed to operate and promote the App.

5.5 Feedback. Suggestions or feedback you provide may be used by us freely and without compensation.

6) Payments and Refunds

The Plux mobile application enables users to make secure electronic payments for services offered through the App. Payments are processed via authorized payment service providers in compliance with applicable Thai laws, including the Electronic Transactions Act and relevant consumer-protection and tax regulations.

Service prices and applicable taxes (including VAT) are clearly displayed before payment confirmation. If a payment fails or is reversed, access to the related service may be suspended until payment is completed. Refunds, if applicable, will be handled according to Thai consumer-protection laws and the policies of the relevant payment service provider.

Payments relate to physical charging services and are processed externally through authorized providers, not as digital content or features sold within the App.

7) Privacy and Data Protection (PDPA Alignment)

We act as the data controller for personal data processed in connection with the App, unless otherwise stated. We collect account, usage, transactional, and communication data as necessary to operate and improve the App in compliance with the PDPA. You may exercise your PDPA rights by contacting us as set out in Section 17.

8) Third-Party Services and Links

The App may interoperate with third-party services. We are not responsible for their content or policies. Use them at your own risk.

9) Electronic Communications and Records

You consent to receive notices and communications electronically. Electronic records and signatures are valid under the Electronic Transactions Act.

10) Disclaimers

The App is provided “as is” without warranties of any kind except those required by Thai Law. We are not responsible for user conduct, device compatibility, or data loss.

11) Limitation of Liability

To the extent permitted by Thai Law, our total liability shall not exceed the greater of (a) fees paid in the last 12 months or (b) THB 3,000. We are not liable for indirect or consequential damages.

12) Indemnification

You agree to defend and hold Plux harmless from claims arising from your breach or unlawful use of the App.

13) Suspension and Termination

We may suspend or terminate your account for violations, risk, or legal compliance. You may request deletion anytime. Sections 5, 7, 9–12, 14–18 survive termination.

14) Platform Provider Terms (Neutral Compliance)

We, not the Platform Provider, are responsible for maintenance, warranty, and product claims. Platform Provider terms still apply, and they may be third-party beneficiaries for compliance purposes.

15) Governing Law and Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand. Disputes will be settled amicably or, failing that, in Thai courts. The parties may optionally agree to arbitration under THAC rules in Bangkok.

16) Changes to Terms

We may update these Terms and will provide notice within the App. Continued use after changes means you accept the new Terms.

18) Miscellaneous

  • These Terms constitute the entire agreement between you and us.
  • If any clause is invalid, the rest remain effective.
  • You may not assign these Terms; we may assign in a merger or sale.
  • No waiver of rights unless in writing.
  • We are not liable for events beyond our control.
  • You must comply with export and sanctions laws.
  • English controls; Thai translation (if provided) may prevail for consumers under Thai Law.
